1. Acceptance of Terms By using the services provided by Amish Payments (“we,” “us,” or “our”), you (“user,” “merchant,” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

2. Services Provided Amish Payments facilitates online credit card transactions for merchants. After processing a payment, we send a check to the designated Amish merchant, retaining a fee for our services.

3. Fees and Deductions We deduct a transaction fee from each payment processed. The remaining amount is sent to the merchant via check. In the event of a refund, the transaction fee will also be deducted from the refunded amount.

4. Refunds Refunds are allowed under our service. The transaction fee will be deducted from the refunded amount. Merchants are responsible for ensuring refund policies comply with applicable laws.

5. Chargebacks Chargebacks are not permitted. We will pursue any chargebacks or related fraudulent activities to the full extent of the law. By using our services, you agree to be held liable for any unauthorized chargebacks and any associated costs.

6. Incorrect Payments and Typos We are not responsible for mispayments or typographical errors made by the user. If an incorrect payment is made, we will refund the amount, less the transaction fees. It is the user’s responsibility to ensure all payment details are accurate before submission.

7. Compliance with Laws You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of our services.

8. Limitations of Liability To the maximum extent permitted by law, Amish Payments shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (iv) any errors or omissions in any content; and (v) any other claim related to your use of the service.

9. Indemnification You agree to indemnify and hold harmless Amish Payments, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of our services.

10. Modification of Terms Amish Payments reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.

11. Termination We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties, or for any other reason at our sole discretion.

12. Governing Law These Terms and your use of the services shall be governed by and construed in accordance with the laws of the state in which Amish Payments operates, without regard to its conflict of law principles.

14. Miscellaneous If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Amish Payments’ failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.
